This Federal Law specifies the rights, duties, and responsibilities of a member of the Federation Council and a deputy of the State Duma of the Federal Assembly of the Russian Federation (hereinafter referred to as a member of the Federation Council and a deputy of the State Duma, respectively) as well as their assistants and stipulates the basic legal and social guarantees when they exercise their powers.

 

Chapter I. GENERAL PROVISIONS 

Article 1. Member of the Federation Council and deputy of the State Duma 

1. A member of the Federation Council is a representative from a constituent entity of the Russian Federation who is authorized in accordance with the federal law on the formation of the Federation Council of the Federal Assembly of the Russian Federation to exercise legislative and other powers envisaged by the Constitution of the Russian Federation and this Federal Law in the Federation Council of the Federal Assembly of the Russian Federation (hereinafter referred to as the Federation Council).

2. A deputy of the State Duma is a representative of the people elected in accordance with the federal law on the election of deputies of the State Duma of the Federal Assembly of the Russian Federation who is authorized to exercise legislative and other powers envisaged by the Constitution of the Russian Federation and this Federal Law in the State Duma of the Federal Assembly of the Russian Federation (hereinafter referred to as the State Duma).

3. A citizen of the Russian Federation who has the citizenship of a foreign country or a residence permit or other document confirming the right to permanent residence on the territory of a foreign country may not be a member of the Federation Council or a deputy of the State Duma.

Article 2. Member of the Federation Council and a deputy of the State Duma in the system of public positions of the Russian Federation

1. The status of a member of the Federation Council and the status of a deputy of the State Duma shall be determined by the Constitution of the Russian Federation and this Federal Law.

2. In terms of social guarantees, members of the Federation Council and deputies of the State Duma are equated to a federal minister; the Chairman of the Chamber and the Deputy Chairmen of the Chamber are equated to the Chairman of the Government of the Russian Federation and a Deputy Prime Minister of the Russian Federation, respectively.

3. The social guarantees of the activities of a member of the Federation Council and a deputy of the State Duma shall include:

a) monthly monetary remuneration, monetary incentives, and other payments envisaged by this Federal Law;

b) annual paid leave;

c) the crediting of the of the exercising of the powers of a member (deputy) of the Federation Council and a deputy of the State Duma towards the length of state civil service;

d) medical and health resort treatment for a member of the Federation Council, a deputy of the State Duma, and members of their families;

e) pension benefits, including pension benefits for members of their families in the event of the death of a member of the Federation Council or a deputy of the State Duma;

f) compulsory state insurance of a member of the Federation Council and a deputy of the State Duma in the event of harm to their health and property;

g) compulsory state social insurance of a member of the Federation Council and a deputy of the State Duma in the event of illness or disability when the member of the Federation Council or deputy of the State Duma exercises his/her powers;

h) housing and utility services for a member of the Federation Council and a deputy of the State Duma who does not have a living space in the city of Moscow;

i) other social guarantees envisaged for federal ministers.

4. Officials of federal state bodies and their regional bodies, the state bodies of the constituent entities of the Russian Federation, and local government bodies shall be obligated within the limits of their competence to ensure that a member of the Federation Council and a deputy of the State Duma has the conditions required to exercise their powers established by the Constitution of the Russian Federation and this Federal Law.

5. Additional conditions for a member of the Federation Council and a deputy of the State Duma with a group I disability to exercise his/her powers shall be determined by a resolution of the corresponding chamber of the Federal Assembly of the Russian Federation.

 

Article 3. Term of office of a member of the Federation Council and a deputy of the State Duma

1. The procedure for establishing the term of office of a member of the Federation Council and the procedure for establishing the start and end dates for a member of the Federation Council to exercise his/her powers shall be determined in accordance with Federal Law No. 113-FZ dated 5 August 2000 “On the Procedure for the Formation of the Federation Council of the Federal Sittings of the Russian Federation„.

2. The term of office of a deputy of the State Duma shall begin on the day of his/her election as a deputy of the State Duma and end as of the day on which a new convocation of the State Duma commences its work, except for cases envisaged by Parts 1, 3, and 5, Article 4 of this Federal Law.

Article 4. Early termination of the powers of a member of the Federation Council and a deputy of the State Duma
(as amended by Federal Law No. 109-FZ dated 4 August 2001) 

1. The powers of a member of the Federation Council and a deputy of the State Duma shall be terminated early in the following cases:

a) a written letter of resignation from a member of the Federation Council and a deputy of the State Duma;

b) the election of a member of the Federation Council or a deputy of the State Duma as a deputy of a legislative (representative) state body of a constituent entity of the Russian Federation or a local government body, an elected official of another state body or local government body as well as the appointment of a member of the Federation Council or a deputy of the State Duma to a different state position of the Russian Federation or state position of a constituent entity of the Russian Federation, and the entry of a member of the Federation Council or a deputy of the State Duma into state or municipal service;

c) the participation of a member of the Federation Council or a deputy of the State Duma in the management of a business company or other commercial organization in the case envisaged by clause d, Part 2, Article 6 of this Federal Law, or the performance of entrepreneurial or other paid activities, except for teaching, scientific, and other creative activities whose funding does not run counter to the requirements envisaged by clause c, Part 2, Article 6 of this Federal Law;

c1) a member of the Federation Council or a deputy of the State Duma joins the management bodies, board of trustees, supervisory boards, or other bodies of foreign non-profit non-governmental organizations and their structural divisions operating on the territory of the Russian Federation unless otherwise stipulated by an international treaty of the Russian Federation or the legislation of the Russian Federation;

c2) the opening (existence) of accounts (deposits) and the storage of cash and valuables in foreign banks located outside the territory of the Russian Federation and the ownership and/or use of foreign financial instruments by a member of the Federation Council or a deputy of the State Duma as well as their spouses and minor children. The concept of “foreign financial instruments„ is used in this Federal Law according to the meaning defined by Federal Law No. 79-FZ dated 7 May 2013 “On the Prohibition of Certain Categories of Persons from Opening and Holding Accounts (Deposits), Storing Cash and Valuables in Foreign Banks Located Outside the Territory of the Russian Federation, and Owning and/or Using Foreign Financial Instruments„;

c3) the establishment of cases involving the opening (existence) of accounts (deposits) and the storage of cash and valuables in foreign banks located outside the territory of the Russian Federation and the ownership and/or use of foreign financial instruments: with respect to a member of the Federation Council – at the time of the consideration by the legislative (representative) state body of a constituent entity of the Russian Federation of the member’s nomination for the conferral of the powers of a member of the Federation Council or a corresponding nomination for the position of the highest official of a constituent entity of the Russian Federation (senior official of the highest executive body of the state authorities of a constituent entity of the Russian Federation) or in the period from the day of the registration by the election commission of a constituent entity of the Russian Federation of the corresponding candidate for the election of the highest official of a constituent entity of the Russian Federation (senior official of the highest executive body of the state authorities of a constituent entity of the Russian Federation) and, in the event of the candidate’s election, prior to the day that this individual adopts a decision to grant the powers of a member of the Federation Council to one of the candidates nominated by this individual, with respect to a deputy of the State Duma – during the period when the individual was registered as a candidate for elections of deputies of the State Duma;

c4) the failure to submit or late submission by a member of the Federation Council or a deputy of the State Duma of information about their income, expenses, property, and property-related liabilities as well as the income, expenses, property, and property-related liabilities of their spouses and minor children;

d) the loss of citizenship of the Russian Federation by a member of the Federation Council or a deputy of the State Duma or the acquisition of the citizenship of a foreign state;

e) the entry into legal force of a court conviction against a person who is a member of the Federation Council or a deputy of the State Duma;

f) the entry into legal force of a court decision restricting the legal capacity of a member of the Federation Council or a deputy of the State Duma or on their recognition as incapacitated;

g) the declaration of a member of the Federation Council or a deputy of the State Duma as missing or deceased based on a court decision that has entered into force;

h) repealed – Federal Law No. 53-FZ dated 19 June 2004;

i) the death of a member of the Federation Council or a deputy of the State Duma.

2. Repealed as of 1 January 2013 – Federal Law No. 238-FZ dated 3 December 2012.

3. The powers of a deputy of the State Duma shall cease in the following cases:

a) the dissolution of the State Duma as envisaged by Articles 111 and 117 of the Constitution of the Russian Federation;

b) withdrawal from a faction in which the deputy is a member in accordance with Article 71 of this Federal Law based on a personal declaration;

c) the failure to comply with the requirements of Part 2, 6, or 7, Article 71 of this Federal Law.

31. The powers of a deputy of the State Duma may be terminated early by the decision of the State Duma based on the initiative of the faction in which the deputy is a member in accordance with Article 71 of this Federal Law, or based on the initiative of the committee in which the deputy is a member in the event of the failure to perform the duties envisaged by Parts 1 and 2, Article 8 and Part 3, Article 12 of this Federal Law for 30 or more calendar days.

4. The decision to terminate the powers of a member of the Federation Council shall be documented by a resolution of the Federation Council which specifies the day of the termination of the member’s powers. A resolution of the Federation Council on the termination of the powers of a member of the Federation Council on the grounds envisaged by clauses a, b, and e – i, Part 1 of this article shall be adopted no later than 30 days from the day grounds originate for the early termination of the powers of the member of the Federation Council, or starting from the day when the Federation Council became aware of such grounds, and if such grounds occurred between sessions of the Federation Council, no later than 30 days from the commencement of the regular session of the Federation Council. A resolution of the Federation Council on the termination of the powers of a member of the Federation Council on the grounds envisaged by clauses c, c1, c2, c3, c4, and d, Part 1 of this article shall be adopted no later than 30 days from the date on which the decision to establish the grounds for the early termination of the powers of a member of the Federation Council is adopted by the body formed (identified) in accordance with the Regulation of the Federation Council of the Federal Assembly of the Russian Federation for the consideration of issues related to the early termination of the powers of a member of the Federation Council. This body shall verify and assess the actual circumstances that serve as grounds for the early termination of the powers of a member of the Federation Council and also decide on the establishment of grounds for the early termination of the powers of a member of the Federation Council in the manner and within the timeframe established by the Regulation of the Federation Council of the Federal Assembly Russian Federation. A resolution of the Federation Council on the termination of the powers of a member of the Federation Council may be appealed to the Supreme Court of the Russian Federation. The guarantees of the activities of a member of the Federation Council envisaged by Article 19 of this Federal Law shall apply to an individual with respect to whom a decision has been adopted to terminate his/her powers as a member of the Federation Council on the grounds envisaged by clauses c, c1, c2, c3, c4, and d, Part 1 of this article for the period during which an appeal may be filed with the Supreme Court of the Russian Federation envisaged by the legislation of the Russian Federation and until a court decision enters into legal force in the event an appeal is filed with the Supreme Court of the Russian Federation. An individual with respect to whom a decision has been adopted to terminate his/her powers as a member of the Federation Council shall have his/her status as a member of the Federation Council restored from the date on which a court decision enters into legal force recognizing the resolution of the Federation Council to terminate the powers of the member of the Federation Council as illegal or unsubstantiated.

5. The decision to terminate the powers of a deputy of the State Duma based on the grounds envisaged by Part 1, clauses b and c, Part 3, and Part 31 of this article shall be documented by a resolution of the State Duma that specifies the day of termination of the deputy’s powers. A resolution of the State Duma on the termination of the powers of a deputy of the State Duma based on the grounds envisaged by clauses a, b, and e – i, Part 1 and clauses b and c, Part 3 of this article shall be adopted no later than 30 days from the day grounds originate for the early termination of the powers of a deputy of the State Duma, or starting from the day when the State Duma became aware of such grounds, and if such grounds occurred between sessions of the State Duma, no later than 30 days from the commencement of the regular session of the State Duma. A resolution of the State Duma on the termination of the powers of a deputy of the State Duma on the grounds envisaged by clauses c, c1, c2, c3, c4, and d, Part 1 of this article shall be adopted no later than 30 days from the date on which the decision to establish the grounds for the early termination of the powers of a deputy of the State Duma is adopted by the body formed (identified) in accordance with the Regulation of the State Duma of the Federal Assembly of the Russian Federation for the consideration of issues related to the early termination of the powers of a deputy of the State Duma. This body shall verify and assess the actual circumstances that serve as grounds for the early termination of the powers of a deputy of the State Duma and also decide on the establishment of grounds for the early termination of the powers of a deputy of the State Duma in the manner and within the timeframe established by the Regulation of the State Duma of the Federal Assembly Russian Federation. A resolution of the State Duma on the termination of the powers of a deputy of the State Duma of the Federal Assembly Russian Federation may be appealed to the Supreme Court of the Russian Federation. The guarantees of the activities of a deputy of the State Duma envisaged by Article 19 of this Federal Law shall apply to an individual with respect to whom a decision has been adopted to terminate his/her powers as a deputy of the State Duma on the grounds envisaged by clauses c, c1, c2, c3, c4, and d, Part 1 of this article for the period during which an appeal may be filed with the Supreme Court of the Russian Federation envisaged by the legislation of the Russian Federation and until a court decision enters into legal force in the event an appeal is filed with the Supreme Court of the Russian Federation. An individual with respect to whom a decision has been adopted to terminate his/her powers as a deputy of the State Duma shall have his/her status as a deputy of the corresponding convocation of the State Duma restored from the date on which a court decision enters into legal force recognizing the resolution of the State Duma to terminate the powers of the deputy of the State Duma as illegal or unsubstantiated. A faction may appeal to the State Duma with a proposal to verify whether a deputy of the State Duma has complied with the restrictions and prohibitions established by this Federal Law. A faction or other individuals with the appropriate public and legal status, the list of which is established by federal law, may file an appeal with the Supreme Court of the Russian Federation concerning the decision (inaction) of the State Duma to reject the early termination of the powers of a deputy of the State Duma. In the case envisaged by clause a, Part 3 of this article, the powers of the deputies of the State Duma concerning the adoption by the State Duma of federal laws as well as its exercising of other constitutional powers through the adoption of decisions at sittings of the chamber shall cease from the day of the scheduling of early elections of State Duma deputies. The body formed by the State Duma in accordance with the Regulation of the State Duma of the Federal Assembly of the Russian Federation to prepare for the chamber’s consideration of issues related to the violation of the rules for the ethics of deputies shall decide whether to establish the grounds for the early termination of the powers of a deputy of the State Duma envisaged by Part 31 of this article. A resolution of the State Duma on the termination of the powers of a deputy of the State Duma on the grounds envisaged by Part 31 of this article shall be adopted no later than 30 days after this body decides to establish grounds for the early termination of the powers of a deputy of the State Duma.

Article 5. Credentials and lapel pins of a member of the Federation Council and a deputy of the State Duma 

1. A member of the Federation Council and a deputy of the State Duma shall have credentials that consist of basic documents confirming the identity and the powers of the member of the Federation Council and deputy of the State Duma as well as lapel pins. They shall use these credentials and lapel pins during their term of office.

2. The credentials of a member of the Federation Council and a deputy of the State Duma shall consist of documents that grant the right to freely pay visits to state bodies and local government bodies, attend sittings of their collegial bodies as well as freely pay visits to military units and organizations regardless of their form of ownership that are fully or partially funded by the federal budget, the budget of a constituent entity of the Russian Federation, or a local budget, have privileges in terms of the payment of taxes and mandatory payments, or whose founders are state bodies and/or local government bodies.

3. Regulations on credentials and lapel pins of a member of the Federation Council and a deputy of the State Duma as well as their samples and descriptions shall be approved by a resolution of the corresponding chamber of the Federal Assembly of the Russian Federation.

 

Article 6. Conditions for the exercising of powers by a member of the Federation Council and a deputy of the State Duma 

1. A member of the Federation Council and a deputy of the State Duma shall exercise their powers on a continuous basis.

11. A member of the Federation Council who concurrently exercises the powers of a member of the Federation Council and a member of a legislative (representative) state body of a constituent entity of the Russian Federation in accordance with Federal Law No. 229-FZ dated 3 December 2012 “On the Procedure for the Formation of the Federation Council of the Federal Assembly of the Russian Federation„, starting from the day of the conferral of the powers of a member of the Federation Council, shall exercise the powers of a deputy of the legislative (representative) state body of a constituent entity of the Russian Federation while still performing core activities in the Federation Council.

2. A member of the Federation Council and a deputy of the State Duma may not:

a) be a deputy of a legislative (representative) state body of a constituent entity of the Russian Federation or a local government body, an elected official of another state body or local government body, or hold another public office of the Russian Federation or public office of a constituent entity of the Russian Federation, except for the case envisaged by Part 11 of this article;

b) serve in the state or municipal service;

c) engage in entrepreneurial or other paid activities, except for teaching, scientific, and other creative activities. Moreover, teaching, scientific, and other creative activities may not be funded solely at the expense of foreign states, international and foreign organizations, foreign citizens and stateless persons unless otherwise stipulated by an international treaty or the legislation of the Russian Federation;

d) participate in activities involving the management of a business company or other commercial organization, including being part of the management bodies of a commercial organization in which tenure is impossible without special personal will, or participate in the work of a general sitting as a supreme management body of a business company;

e) be part of the management bodies, boards of trustees, supervisory boards, or other bodies of foreign non-profit non-governmental organizations or their structural subdivisions operating on the territory of the Russian Federation unless otherwise stipulated by an international treaty of the Russian Federation or the legislation of the Russian Federation;

f) receive remuneration (loans, monetary or other remuneration, services, or payment of entertainment, holiday, or transportation expenses) from individuals and legal entities in connection with the exercising of the relevant powers. Gifts received by a member of the Federation Council or a deputy of the State Duma in connection with protocol events, official trips, and other official events shall be recognized as federal property and be transferred by a member of the Federation Council or a deputy of the State Duma to the Federation Council or State Duma, respectively, under a handover deed, except for cases envisaged by the legislation of the Russian Federation. A member of the Federation Council or a deputy of the State Duma who has handed over a gift received in connection with a protocol event, an official trip, or other official event may redeem it in the manner prescribed by the regulatory legal acts of the Russian Federation;

g) leave the territory of the Russian Federation in connection with the exercising of the relevant powers at the expense of individuals and legal entities, except for official business trips made in accordance with the legislation of the Russian Federation, international treaties of the Russian Federation, or agreements on a reciprocal basis between federal state bodies and the state bodies of the constituent entities of the Russian Federation with the state bodies of foreign states as well as international and foreign organizations;

h) utilize means of material, technical, financial, and information support intended for official activities for purposes not related to the exercising of the relevant powers;

i) disclose or use information classified under federal law as information with restricted access for purposes not related to the exercising of the relevant powers or official information that has become known in connection with the exercising of the relevant powers;

j) open or have accounts (deposits) or store cash or valuables in foreign banks located outside the territory of the Russian Federation or own and/or use foreign financial instruments.

21. If the ownership by a member of the Federation Council or a deputy of the State Duma of income-producing securities or shares (equity stakes in the authorized capital of organizations) may lead to a conflict of interest, the member or deputy must transfer the securities or shares (equity stakes in the authorized capital of organizations) to trust management in accordance with the legislation of the Russian Federation.

22. A member of the Federation Council and a deputy of the State Duma must report any personal interest in the exercising of their powers that leads to or may lead to a conflict of interests to the commission of the Federation Council or the State Duma, respectively, in charge of monitoring the reliability of information about income, property, and property-related obligations submitted by members of the Federation Council or deputies of the State Duma and also take measures to prevent or resolve such a conflict in the manner prescribed by the corresponding chamber of the Federal Assembly of the Russian Federation if such grounds exist.

3. Members of the Federation Council and deputies of the State Duma who are rank and file or commanding officers of the internal affairs bodies or the State Fire Service, employees of prosecutorial authorities, customs authorities, narcotics and psychotropic control authorities, or institutions and bodies of the penal system, or officers of the Investigative Committee of the Russian Federation on the day of the start of their terms must suspend their service at such bodies and institutions for their entire term in office.

4. The period during which service in the bodies and institutions specified in Part 3 of this article is suspended shall be included in the length of service of servants or employees in such bodies and institutions. During this period, payment of monetary allowances (remuneration) and other funds envisaged by federal legislation for servants and employees of these bodies and institutions as well as the assignment of regular special ranks and class ranks shall not take place. During this period, a member of the Federation Council or a deputy of the State Duma may resign from these bodies and institutions on the grounds envisaged by federal legislation.

5. A legislative (representative) body of the state authorities of a constituent entity of the Russian Federation and the highest executive body of the state authorities of a constituent entity of the Russian Federation must provide transport vehicles, a separate guarded premises equipped with furniture, communication equipment, including government equipment, and the necessary office equipment, including personal computers connected to the general network of the relevant state authorities, printers, and copying equipment to a member of the Federation Council who is a representative of a legislative (representative) body of the state authorities of a constituent entity of the Russian Federation or the executive body of the state authorities of a constituent entity of the Russian Federation, respectively, in order to exercise his/her powers in the territory of the relevant constituent entity of the Russian Federation and must also ensure other conditions for such a member to exercise the powers envisaged by this Federal Law.

7. The executive body of the relevant constituent entity of the Russian Federation must provide transport vehicles, a separate guarded premises equipped with furniture, communication equipment, including government equipment, and the necessary office equipment, including personal computers connected to the general network of the relevant state authorities, printers, and copying equipment to a deputy of the State Duma in order for the deputy to exercise his/her powers in the territory determined in accordance with Part 1, Article 8 of this Federal Law and must also ensure other conditions for such a deputy to exercise the powers envisaged by this Federal Law.

8. The head of the executive body of a constituent entity of the Russian Federation or local government body shall be responsible for creating the conditions envisaged by this Federal Law for a deputy of the State Duma and his/her assistants to exercise their powers.

Article 7. Forms of activity of a member of the Federation Council and a deputy of the State Duma 

1. The forms of activity of a member of the Federation Council and a deputy of the State Duma shall include:

a) participation in sittings of the Federation Council and State Duma, respectively, in the manner prescribed by the regulations of the chambers of the Federal Assembly of the Russian Federation; in joint sessions of the chambers of the Federal Assembly of the Russian Federation;

b) participation in the work of committees and commissions of the chambers of the Federal Assembly of the Russian Federation in the manner prescribed by the regulations of the chambers of the Federal Assembly of the Russian Federation; in the work of conciliation and special commissions set up by the Federation Council and the State Duma; in the work of parliamentary commissions established by the Federation Council and the State Duma in the manner prescribed by Federal Law No. 196-FZ dated 27 December 2005 “On the Parliamentary Investigation of the Federal Assembly of the Russian Federation„ as well as working groups established by these parliamentary commissions;

c) participation in the fulfilment of instructions assigned by the Federation Council, the State Duma, and their bodies, respectively;

d) participation in parliamentary hearings;

e) submission of bills to the State Duma;

f) submitting a parliamentary request (request of the Federation Council or the State Duma) or a request of a member of the Federation Council or a deputy of the State Duma (deputy inquiry);

g) addressing questions to members of the Government of the Russian Federation at a sitting of the corresponding chamber of the Federal Assembly of the Russian Federation;

h) contacting the appropriate officials with a request to take measures to immediately suppress violation of citizens’ rights that have been identified.

2. Another form of activity of a deputy of the State Duma is working with voters, while a deputy of the State Duma who is a member of a faction in the State Duma in accordance with Article 71 of this Federal Law must also participate in the work of the relevant faction.

3. A member of the Federation Council and a deputy of the State Duma may engage in activities in other forms envisaged by the Constitution of the Russian Federation, this Federal Law, other federal laws, and regulations of the chambers of the Federal Assembly of the Russian Federation.

Article 71. Factions in the State Duma
(introduced by Federal Law No. 93-FZ dated 21 July 2005 (amended on 12 July 2006)) 

1. A faction is an association of deputies of the State Duma who are elected as part of a federal list of candidates and admitted to the allocation of deputy seats in the State Duma. A faction shall include all deputies of the State Duma elected in the corresponding federal list of candidates, except for the case envisaged by Part 5 of this article. The faction may also include deputies of the State Duma who are elected as part of the federal list of candidates of the political party indicated in Part 5 of this article. Factions in the State Duma shall be registered in accordance with the Regulation of the State Duma of the Federal Assembly of the Russian Federation.

2. A deputy of the State Duma who is a member of a faction in accordance with Part 1 of this article may only be a member of the political party in whose federal list of candidates he/she was elected as a deputy of the State Duma.

3. A faction in the State Duma shall organize its activities in accordance with this Federal Law, Federal Law No. 95-FZ dated 11 July 2001 “On Political Parties„, and the Regulation of the State of the Federal Assembly of the Russian Federation.

4. Repealed as of 1 January 2013 – Federal Law No. 287-FZ dated 20 October 2011.

5. If the activities of a political party are terminated in connection with its liquidation or reorganization, the activities of the faction of this political party in the State Duma as well as the membership of deputies of the State Duma in this faction or the validity of restrictions established by Part 4 of this article shall cease from the date on which the corresponding entry is made in the Unified State Register of Legal Entities.

6. A deputy of the State Duma who is elected as part of a federal list of candidates of the political party specified in Part 5 of this article and is part of a faction in the State Duma may only be a member of the political party in whose faction it is a member.

7. A deputy of the State Duma who is elected as part of the federal list of candidates of the political party specified in Part 5 of this article and has joined a political party that has a faction in the State Duma shall be a member of this faction and may not withdraw from it.

8. Deputies of the State Duma who are elected as part of the federal list of candidates of the political party specified in Part 5 of this article and are not members of a faction in the State Duma may form deputy associations that are not factions. The procedure for the activities of these deputy associations shall be established by the Regulation of the State Duma of the Federal Assembly of the Russian Federation.

Article 8. Interaction between a deputy of the State Duma and voters 

1. A deputy of the State Duma must maintain contact with voters. A deputy of the State Duma who was a candidate in a regional group of candidates of a federal list of candidates shall maintain contact with voters in the territory corresponding to this regional group of candidates (i.e., with voters in the corresponding constituent entity of the Russian Federation, the corresponding group of constituent entities of the Russian Federation, or part of the territory of a constituent entity of the Russian Federation). A faction may additionally designate a deputy of the State Duma from the faction who was a candidate in a regional group of candidates of the relevant federal list of candidates to maintain contact with voters of a constituent entity (entities) of the Russian Federation that is (are) not covered by regional groups of candidates of this list between which seats are distributed. No more than one deputy of the State Duma from the faction who was a candidate in the regional group of candidates of the corresponding federal list of candidates may maintain contact with voters in a given constituent entity (entities) of the Russian Federation. At the same time, the number of constituent entities of the Russian Federation in which a deputy of the State Duma maintains contact with voters may not exceed three. A deputy of the State Duma who was a candidate in the federal part of the federal list of candidates shall maintain contact with voters in a constituent entity (entities) of the Russian Federation not covered by regional groups of candidates of this list between which deputy seats are distributed and, if necessary, in another constituent entity (entities) of the Russian Federation as well. For such a deputy of the State Duma, the constituent entity (entities) of the Russian Federation shall be determined by the faction in the State Duma in which it is a member in accordance with Article 71 of this Federal Law. A deputy of the State Duma who is elected in a single-mandate electoral district shall maintain contact with voters in his/her district.

2. A deputy of the State Duma must consider appeals from voters, personally receive citizens in the manner and within the timeframe prescribed by the Regulation of the State Duma of the Federal Assembly of the Russian Federation but at least once every two months, hold meetings with voters at least once every six months, and also carry out other measures envisaged by the legislation of the Russian Federation that ensure contact with voters.

3. A deputy of the State Duma shall inform voters about his/her activities during meetings with them as well as through the media.

4. A deputy of the State Duma shall be assigned the appropriate monthly days to work with voters in the manner determined by the Regulation of the State Duma of the Federal Assembly of the Russian Federation.

5. Meetings which a deputy of the State Duma holds with voters to inform them about his/her activities shall be conducted within the territory assigned to this deputy of the State Duma in accordance with Part 1 of this article.

6. Meetings which a deputy of the State Duma holds with voters shall be in offices, specially designated places as well as in courtyard areas, provided that holding such meetings does not result in a disruption to the functioning of vital facilities, transport or social infrastructure, or communications. No notification of the executive bodies of a constituent entity of the Russian Federation or local government bodies about such meetings is required. At the same time, a deputy of the State Duma may inform such bodies about the date and time of such meetings.

7. The executive bodies of a constituent entity of the Russian Federation (local government bodies) shall determine specially designated places for meetings of deputies of the State Duma with voters and also determine the list of premises provided by the executive bodies of a constituent entity of the Russian Federation (local government bodies) for deputies of the State Duma to hold meetings with voters and the procedure for their provision.

8. Obstructing the organization or holding of meetings of deputies of the State Duma with voters held in accordance with this Federal Law shall entail administrative responsibility in accordance with the legislation of the Russian Federation.

9. Meetings of a deputy of the State Duma with voters in the form of a public event shall be held in accordance with the legislation of the Russian Federation at gatherings, rallies, demonstrations, marches, and pickets.

10. Obstructing the organization or holding of meetings of deputies of the State Duma with voters in the form of a public event specified by the legislation of the Russian Federation on gatherings, rallies, demonstrations, marches, and picketing shall entail administrative responsibility in accordance with the legislation of the Russian Federation.

Article 9. Observance of ethical standards by a member of the Federation Council and a deputy of the State Duma 

A member of the Federation Council and a deputy of the State Duma must observe ethical standards. Responsibility for violation of such standards by a member of the Federation Council or a deputy of the State Duma shall be established by the regulations of the chambers of the Federal Assembly of the Russian Federation.

 

Article 10. Information about income, expenses, property, and property-related liabilities of a member of the Federation Council and a deputy of the State Duma as well as their spouses and minor children
(as amended by Federal Laws No. 329-FZ dated 21 November 2011 and No. 231-FZ dated 3 December 2012) 

1. Members of the Federation Council and deputies of the State Duma must annually submit information about their income, expenses, property, and property-related liabilities as well as the income, expenses, property, and property-related liabilities of their spouses and minor children to the commission of the Federation Council or the State Duma, respectively, in charge of monitoring the reliability of information about income, property, and property-related obligations submitted by members of the Federation Council or deputies of the State Duma (hereinafter the parliamentary commission) no later than 1 April of the year following the reporting fiscal year.

2. The parliamentary commission shall be established in each of the chambers of the Federal Assembly of the Russian Federation in the manner determined by the corresponding chamber of the Federal Assembly of the Russian Federation.

3. The parliamentary commission shall conduct the following checks in the manner determined by the corresponding chamber of the Federal Assembly of the Russian Federation:

a) the reliability and completeness of information on income, expenses, property, and property-related liabilities submitted by members of the Federation Council and deputies of the State Duma;

b) the observance by members of the Federation Council and deputies of the State Duma of restrictions and prohibitions established by federal constitutional laws, this Federal Law, and other federal laws.

4. Grounds for conducting a check shall include sufficient information submitted in writing in the prescribed manner by:

a) law enforcement or tax authorities;

b) the permanent governing bodies of political parties and other national public associations registered in accordance with the law that are not political parties;

c) the Public Chamber of the Russian Federation;

d) national mass media.

5. Information of an anonymous nature may not serve as a basis for conducting a check.

6. The results of a check shall be considered at an open meeting of the parliamentary commission which representatives of the media may attend in the prescribed manner.

7. Information revealed by the parliamentary commission about the submission by a member of the Federation Council or a deputy of the State Duma of knowingly inaccurate or incomplete information about income, expenses, property, and property-related liabilities shall be subject to publication in the official printed publication of the Federal Assembly of the Russian Federation and placement on the official website of the Federation Council and the State Duma, respectively.

8. The procedure for the placement of information about income, expenses, property, and property-related liabilities submitted by members of the Federation Council and deputies of the State Duma on the official website of the Federation Council and the State Duma, respectively, and the procedure for providing this information to national mass media for publication in connection with their requests shall be determined by the corresponding chamber of the Federal Assembly of the Russian Federation.

9. Responsibility for violation by a member of the Federation Council or a deputy of the State Duma of the restrictions, prohibitions, and duties established by federal constitutional laws, this Federal Law, and other federal laws in order to combat corruption shall be established by federal laws and resolutions of the chambers of the Federal Assembly of the Russian Federation.

10. Based on the decision of the President of the Russian Federation, the Head of the Administration of the President of the Russian Federation, or an authorized official of the Administration of the President of the Russian Federation specially designated by the former, an authorized division of the Administration of the President of the Russian Federation may carry out the check specified in Part 3 of this article in the prescribed manner. The check envisaged by this part may be carried out independently from the check conducted by the parliamentary commission established in each of the chambers of the Federal Assembly of the Russian Federation in accordance with this article.

Chapter II. GUARANTEES FOR THE ACTIVITIES OF A MEMBER OF THE FEDERATION COUNCIL AND A DEPUTY OF THE STATE DUMA 

Article 11. Right to introduce a legislative initiative by a member of the Federation Council and a deputy of the State Duma 

1. A member of the Federation Council and a deputy of the State Duma shall have the right to introduce a legislative initiative, which shall be exercised in the form of submitting bills and changes thereto to the State Duma.

2. A group of at least one-fifth of the members of the Federation Council or deputies of the State Duma may submit proposals for amendments to the Constitution of the Russian Federation and the revision of the provisions of the Constitution of the Russian Federation.

3. The legislative initiatives listed in Parts 1 and 2 of this article shall be subject to mandatory consideration by the State Duma.

4. The procedure for exercising the right to introduce a legislative initiative by a member of the Federation Council or a deputy of the State Duma shall be determined by the Constitution of the Russian Federation, this Federal Law, and the regulations of the chambers of the Federal Assembly of the Russian Federation.

 

Article 12. Participation by a member of the Federation Council and a deputy of the State Duma in a sitting of the corresponding chamber of the Federal Assembly of the Russian Federation and also in a sitting of the committee and commission of the corresponding chamber of the Federal Assembly of the Russian Federation and a conciliation and special commission

1. A member of the Federation Council and a deputy of the State Duma shall enjoy the right of a decisive vote on all matters considered by the corresponding chamber of the Federal Assembly of the Russian Federation, a committee or commission of this chamber of the Federal Assembly of the Russian Federation, or a conciliation or special commission of which they are members.

2. A member of the Federation Council and a deputy of the State Duma shall exercise the rights granted to them in accordance with the Constitution of the Russian Federation, this Federal Law, and the regulations of the chambers of the Federal Assembly of the Russian Federation at the sittings of the corresponding chamber of the Federal Assembly of the Russian Federation, a committee or commission of this chamber, or a conciliation or special commission.

3. A member of the Federation Council and a deputy of the State Duma must personally take part in the sitting of the corresponding chamber of the Federal Assembly of the Russian Federation as well as a committee, commission, conciliation commission, or special commission of which they are members in the manner prescribed by the regulations of the chambers of the Federal Assembly of the Russian Federation. If it is impossible to attend a sitting of the corresponding chamber of the Federal Assembly of the Russian Federation or a committee, commission, conciliation commission, or special commission for a valid reason, the member of the Federation Council or deputy of the State Duma shall inform the Speaker of the Federation Council of the Federal Assembly of the Russian Federation or the Chairman of the State Duma of the Federal Assembly of the Russian Federation, respectively, or the chair of the committee or commission, or the co-chairman of the conciliation or special commission. Responsibility for the absence of a member of the Federation Council or a deputy of the State Duma at a sitting of the corresponding chamber of the Federal Assembly of the Russian Federation without a valid reason shall be established by the regulations of the chambers of the Federal Assembly of the Russian Federation.

4. A member of the Federation Council and a deputy of the State Duma may attend any sitting of either of the chambers of the Federal Assembly of the Russian Federation.

 

Article 13. Parliamentary inquiry 

1. The Federation Council and the State Duma may send a parliamentary inquiry to the Chairman of the Government of the Russian Federation, members of the Government of the Russian Federation, the Prosecutor General of the Russian Federation, the Chairman of the Investigative Committee of the Russian Federation, the Governor of the Central Bank of the Russian Federation, the Chairperson of the Central Election Commission of the Russian Federation, the chairpersons of other election commissions, the chairpersons of referendum commissions, the Chairman of the Accounts Chamber of the Russian Federation, heads of other federal bodies of the state authorities, the state authorities of the constituent entities of the Russian Federation, and local government bodies as well as the Pension Fund of the Russian Federation, the Social Insurance Fund of the Russian Federation, and the Federal Compulsory Medical Insurance Fund of the Russian Federation on matters falling within the competence of these bodies and officials in compliance with the requirements envisaged by Article 18 of this Federal Law.

2. A parliamentary inquiry shall be adopted by a majority vote of the total number of members or deputies of the corresponding chamber of the Federal Assembly of the Russian Federation in the manner prescribed by the regulations of the chambers of the Federal Assembly of the Russian Federation.

3. An official to whom a parliamentary inquiry has been sent must reply to it either verbally (at a sitting of the corresponding chamber of the Federal Assembly of the Russian Federation) or in writing no later than 15 days after the receipt of the parliamentary inquiry or within another period established by the corresponding chamber of the Federal Assembly of the Russian Federation. The reply must be signed by the official to whom the parliamentary inquiry was sent or by an individual temporarily fulfilling his/her duties. A written response to a parliamentary inquiry shall be announced by the chairperson of the sitting of the corresponding chamber of the Federal Assembly of the Russian Federation. Copies of a written response shall be sent to all members of the chamber of the Federal Assembly on whose behalf the parliamentary inquiry was sent.

 

Article 14. Inquiry of a member of the Federation Council or a deputy of the State Duma (deputy’s inquiry) 

1. A member of the Federation Council and a deputy of the State Duma (the initiator of an inquiry) may send an inquiry to the Chairman of the Government of the Russian Federation, members of the Government of the Russian Federation, the Prosecutor General of the Russian Federation, the Chairman of the Investigative Committee of the Russian Federation, the Governor of the Central Bank of the Russian Federation, the Chairperson of the Central Election Commission of the Russian Federation, the chairpersons of other election commissions, the chairpersons of referendum commissions, heads of other federal bodies of the state authorities, the state authorities of the constituent entities of the Russian Federation, and local government bodies as well as the Pension Fund of the Russian Federation, the Social Insurance Fund of the Russian Federation, and the Federal Compulsory Medical Insurance Fund of the Russian Federation on matters falling within the competence of these bodies and officials in compliance with the requirements envisaged by Article 18 of this Federal Law.

2. An inquiry sent by a member of the Federation Council and a deputy of the State Duma shall be sent independently and shall not require announcement at a sitting of the corresponding chamber of the Federal Assembly of the Russian Federation.

3. An official to whom an inquiry is sent must reply to it in writing no later than 30 days from the date of receipt or within another period agreed upon with the initiator of the inquiry.

4. The initiator of an inquiry may take direct part in the consideration of the questions it posed in the inquiry, including in closed sittings of the relevant bodies, in compliance with the requirements envisaged by Article 18 of this Federal Law. The initiator of the inquiry must be notified in advance about the day of the consideration of the questions posed in the inquiry, but no later than three days prior to the day of the sitting of the relevant body.

5. The response to the inquiry must be signed by the official to whom the inquiry was sent or by a person temporarily performing his/her duties.

 

Article 15. Invitation of members of the Government of the Russian Federation and other officials to a sitting of the corresponding chamber of the Federal Assembly of the Russian Federation 

1. The Federation Council and the State Duma may invite the Chairman of the Government of the Russian Federation, members of the Government of the Russian Federation, the Prosecutor General of the Russian Federation, the Chairman of the Investigative Committee of the Russian Federation, the Governor of the Central Bank of the Russian Federation, the Chairperson of the Central Election Commission of the Russian Federation, heads of other federal bodies of the state authorities, bodies of state authorities of the constituent entities of the Russian Federation, and local government bodies as well as the Chairman of the Pension Fund of the Russian Federation, the Chairman of the Social Insurance Fund of the Russian Federation, and the Chairman of the Federal Compulsory Medical Insurance Fund of the Russian Federation to a sitting of the corresponding chamber of the Federal Assembly of the Russian Federation.

2. In accordance with the rules of procedure of the corresponding chamber of the Federal Assembly of the Russian Federation, a time shall be envisaged for members and deputies of the corresponding chamber of the Federal Assembly of the Russian Federation to address questions to the officials listed in Part 1 of this article and receive answers to them.

3. If an invited official is unable to be present at a sitting of the corresponding chamber of the Federal Assembly of the Russian Federation at a pre-agreed time, the official may either come at a different time in agreement with the Speaker of the Federation Councilof the Federal Assembly of the Russian Federation or the Chairman of the State Duma of the Federal Assembly Russian Federation, respectively, or send a deputy to the sitting of the corresponding chamber of the Federal Assembly of the Russian Federation.

 

Article 16. Right a member of the Federation Council and a deputy of the State Duma to be received on a priority basis by leaders and other officials 

On matters concerning its activities, a member of the Federation Council and a deputy of the State Duma shall enjoy the right to be received on a priority basis by the heads and other officials of federal bodies, state bodies of the constituent entities of the Russian Federation, other state bodies, local government bodies, other municipal bodies, organizations regardless of the form of ownership, military command and control bodies, associations, alliances, military units, and organizations of the Armed Forces of the Russian Federation, military forces, and military formations.

Article 17. Right of a member of the Federation Council and a deputy of the State Duma to receive and disseminate information 

1. Officials of the central office of the corresponding chamber of the Federal Assembly of the Russian Federation shall provide members of the Federation Council and deputies of the State Duma in the manner prescribed by the regulations of the chambers of the Federal Assembly of the Russian Federation with documents adopted by the chambers of the Federal Assembly of the Russian Federation, the printed publications of the chambers of the Federal Assembly of the Russian Federation, other documents as well as information and reference materials, including those officially distributed by the Administration of the President of the Russian Federation, the Government of the Russian Federation, the Constitutional Court of the Russian Federation, the Supreme Court of the Russian Federation, the Accounts Chamber of the Russian Federation, the Central Election Commission of the Russian Federation, and other state bodies.

2. If a member of the Federation Council and a deputy of the State Duma contacts state bodies, local government bodies, public associations, and organizations on matters concerning their activities, the officials of these bodies, associations, and organizations shall immediately (and if it is necessary to receive additional materials – no later than 30 days from the date of receipt of the request) provide a response to this request and submit the requested documents or information. At the same time, information constituting a state secret shall be provided in accordance with the procedure established by the federal law on state secrets.

3. If it is necessary to carry out an additional check or to request any additional materials, the officials specified in Part 2 of this article must inform the member of the Federation Council or deputy of the State Duma who contacted them.

4. A member of the Federation Council and a deputy of the State Duma may speak about matters concerning their activities in the state mass media in the manner prescribed by the federal law on the procedure for covering the activities of the state authorities in the state mass media.

5. Value indicators shall be indicated by a member of the Federation Council and a deputy of the State Duma in accordance with the requirements established by the legislation of the Russian Federation and the regulations of the chambers of the Federal Assembly of the Russian Federation.

Article 18. Inadmissibility of interference by a member of the Federation Council and a deputy of the State Duma in the activities of bodies of inquiry, investigators, and courts 

1. Interference by a member of the Federation Council and a deputy of the State Duma in the investigative and criminal procedure activities of bodies of inquiry and investigators as well as judicial activities shall not be permitted.

2. A member of the Federation Council or a deputy of the State Duma may not participate as a defender or representative (except in cases of legal representation) in a civil, administrative, criminal, or administrative offence case.

Article 19. Immunity of a member of the Federation Council and a deputy of the State Duma 

1. A member of the Federation Council and a deputy of the State Duma shall enjoy immunity throughout their term of office.

2. Without the consent of the corresponding chamber of the Federal Assembly of the Russian Federation, a member of the Federation Council and a deputy of the State Duma may not be:

a) subjected to criminal or administrative responsibility imposed by a court;

b) detained, arrested, searched (except in cases of arrest at a crime scene), or interrogated;

c) subjected to personal search, except in cases where this is envisaged by federal law to ensure the safety of other people.

3. The immunity of a member of the Federation Council and a deputy of the State Duma shall apply to their residential and office premises, personal and official vehicles used by them, communications facilities, documents and luggage belonging to them as well as their correspondence.

4. In the event that a criminal case is opened or proceedings are initiated in an administrative offence case that envisages administrative liability imposed in court with respect to the actions of a member of the Federation Council or a deputy of the State Duma, a body of inquiry or investigator shall inform the Prosecutor General of the Russian Federation about this within three days. If a criminal case is opened or proceedings are initiated in an administrative offence case that envisages administrative liability imposed in court with respect to the actions of a member of the Federation Council or a deputy of the State Duma associated with the exercising of their powers, the Prosecutor General of the Russian Federation must submit a proposal to the corresponding chamber of the Federal Assembly of the Russian Federation on depriving the member of the Federation Council or deputy of the State of immunity within a week after receiving the message from the body of inquiry or investigator.

5. Once an inquiry, preliminary investigation, or proceedings have been completed in an administrative offence case that envisages administrative liability imposed in court, the case may not be referred to a court without the consent of the corresponding chamber of the Federal Assembly of the Russian Federation.

6. A member of the Federation Council and a deputy of the State Duma may not be subject to criminal or administrative responsibility for expressing an opinion or expressing a position during voting in the corresponding chamber of the Federal Assembly of the Russian Federation or other actions commensurate with the status of a member of the Federation Council and the status of a deputy of the State Duma, including after the expiry of their term of office. If in connection with such actions a member of the Federation Council or a deputy of the State Duma committed public insults, slander, or other violations for which liability is envisaged by federal law, the opening of a criminal case or an inquiry, preliminary investigation, or proceedings in an administrative offence case that envisages administrative liability imposed in court shall only take place in the event that the member of the Federation Council or deputy of the State Duma has been deprived of immunity.

 

Article 20. Procedure for obtaining consent to deprive a member of the Federation Council or a deputy of the State Duma of immunity 

1. The issue of depriving a member of the Federation Council or a deputy of the State Duma of immunity shall be resolved based on a proposal from the Prosecutor General of the Russian Federation by the corresponding chamber of the Federal Assembly of the Russian Federation.

2. The Federation Council and the State Duma shall consider a proposal from the Prosecutor General of the Russian Federation in the manner prescribed by the regulation of the corresponding chamber of the Federal Assembly of the Russian Federation and adopt a reasoned decision on this proposal and notify the Prosecutor General of the Russian Federation about it within three days. Additional materials may be requested from the Prosecutor General of the Russian Federation based on the decision of the corresponding chamber of the Federal Assembly of the Russian Federation. The member of the Federation Council or deputy of the State Duma with respect to whom the proposal was made may take part in the consideration of the matter at a sitting of the corresponding chamber of the Federal Assembly of the Russian Federation.

3. The refusal of the corresponding chamber of the Federal Assembly of the Russian Federation to give consent to the deprivation of immunity of a member of the Federation Council or a deputy of the State Duma shall constitute a circumstance that precludes proceedings in a criminal case or proceedings in an administrative offense case involving administrative liability imposed in court and shall result in the termination of such cases. The decision to terminate the relevant case may only be cancelled if newly discovered circumstances come to light.

4. A body of inquiry, investigator, or court shall inform the corresponding chamber of the Federal Assembly of the Russian Federation within three days about the opening of a criminal case or the start of proceedings in an administrative offence case that envisages administrative liability imposed in court, the termination of a corresponding case, or a final court that has entered into legal force with respect to a member of the Federation Council or a deputy of the State Duma.

 

Article 21. Right of a member of the Federation Council and a deputy of the State Duma to refuse to testify 

A member of the Federation Council and a deputy of the State Duma may refuse to give testimony in a civil, administrative, or criminal case about circumstances that have become known to them in connection with the exercising of their powers.

Article 22. Compulsory state insurance of a member of the Federation Council and a deputy of the State Duma 

A member of the Federation Council and a deputy of the State Duma shall be subject to compulsory state insurance from federal budget resources for the amount of the annual remuneration of a deputy of the State Duma in the event of:

a) death if such death occurred as a result of bodily harm or other harm to their health;

b) causing injury or other harm to health.

 

Article 23. Compensation for harm caused to the life or health a member of the Federation Council or a deputy of the State Duma 

1. In the event that a member of the Federation Council or a deputy of the State Duma is injured or suffers other damage to their health resulting in the loss of ability to work, they shall be paid monthly compensation in the amount of the difference between the monthly remuneration of the deputy of the State Duma on the day of payment of compensation and the designated pension without offsetting the amounts of state insurance payments.

2. In the event of the death of a member of the Federation Council or a deputy of the State Duma, material support for members of the deceased’s family shall be provided in the manner prescribed by the federal law on material support for family members of a deceased member of the Federation Council.

 

Article 24. Repealed – Federal Law No. 53-FZ dated 19 June 2004. 


Article 25. Guarantees of the labour rights of a member of the Federation Council and a deputy of the State Duma 

1. The term of office of a member of the Federation Council and a deputy of the State Duma shall be counted towards the length of federal state service.

2. The term of office of a member of the Federation Council and a deputy of the State Duma shall be counted towards the general and uninterrupted length of service or tenure of employment as well as employment experience in the same occupation. At the same time, uninterrupted length of service shall be preserved provided that they return to work or service within six months after the termination of the powers of a member of the Federation Council or a deputy of the State Duma.

3. A member of the Federation Council and a deputy of the State Duma who worked prior to election (appointment) as a member of the Federation Council or election as a deputy of the State Duma under an employment contract shall be granted their previous job (position) following the termination of their powers or another equivalent job (position) at the previous place of work or in another organization with their consent if this job (position) no longer exists.

4. Servicemen, rank and file or commanding officers of the internal affairs bodies, the State Fire Service, prosecutorial authorities, customs authorities, narcotics and psychotropic control authorities, or institutions and bodies of the penal system, or employees of the Investigative Committee of the Russian Federation elected by members of the Federation Council and elected by the deputies of the State Duma may continue military service (service in these bodies) or resign from military service (service in these bodies) prior to the scheduled time upon termination of their term of office. At the end of the term of office, a member of the Federation Council and a deputy of the State Duma shall be given their previous position or another position at the previous or another place of service with their consent.

5. For a spouse of a member of the Federation Council or a deputy of the State Duma who resigns in connection with the relocation to the corresponding chamber of the Federal Assembly of the Russian Federation by the member of the Federation Council or deputy of the State Duma to exercise their powers, the interruption in work shall be credited to the general and uninterrupted length of work (service). Over this period they shall retain: employment (service) experience in the same occupation; length of employment (service) that grants the right to establish percentage increments (including locality pay factors) for salaries, to establish percentage increments and receive lump-sum remuneration for length of service, to the payment of remuneration based on work at an organization for the year during which relocation took place as well as to a pension on preferential terms and in preferential amounts if these individuals held a job, worked in a profession, or worked (served) in the locality that envisage the provision of the appropriate benefits at the time of relocation.

Article 26. Rights of a deputy of the State Duma in the event of the dissolution of the State Duma 

1. In the event of the dissolution of the State Duma in accordance with Articles 111 and 117 of the Constitution of the Russian Federation, a deputy of the State Duma shall be entitled to receive a lump-sum cash monetary allowance equal to three times the amount of his/her monthly remuneration as of the day of the termination of his/her deputy powers.

2. Deputies of the State Duma and members of their family residing together with them who are located outside their permanent residence as of the day of dissolution of the State Duma shall be provided with free transportation and free shipment of their property (in containers weighing up to ten tonnes) to the permanent place of residence of the deputy.

3. A deputy of the State Duma who has the pension insurance record required to receive an old-age insurance pension (including an old-age insurance pension granted ahead of schedule) whose powers are terminated in connection with the dissolution of the State Duma shall receive such a pension ahead of schedule with his/her consent, but no earlier than two years prior to the retirement age established by the legislation of the Russian Federation. At the same time, the deputy shall be entitled to monthly supplemental payments to this pension in accordance with Article 29 of this Federal Law.

Article 27. Provision of the material and financial conditions for members of the Federation Council and deputies of the State Duma to exercise their powers
(as amended by Federal Law No. 109-FZ dated 4 August 2001) 

1. Members of the Federation Council, regardless of the position they hold in the Federation Council, except for the Speaker of the Federation Council of the Federal Assembly of the Russian Federation, and deputies of the State Duma, regardless of the position they hold in the State Duma, except for the Chairman of the State Duma of the Federal Assembly, shall be granted the same monthly remuneration and the same monetary incentives in the amounts established for a federal minister.

2. The Speaker of the Federation Council of the Federal Assembly of the Russian Federation and the Chairman of the State Duma of the Federal Assembly of the Russian Federation shall be granted monthly remuneration in the amount of the monthly monetary remuneration of the Chairman of the Government of the Russian Federation.

3. A member of the Federation Council and a deputy of the State Duma shall be allocated funds for the material support of their activities envisaged by this Federal Law. The volume of payments shall be determined based on a list of expenditures for the material support of a member of the Federation Council and a deputy of the State Duma established annually according to the resolutions of the Federation Council and the State Duma, respectively, in accordance with the regulations of the chambers of the Federal Assembly of the Russian Federation within the limits envisaged by the federal law on the federal budget of the corresponding year for the functioning of the Federation Council and the State Duma.

4. Monthly remuneration for members of the Federation Council shall be paid starting from the date on which the decision enters into force on their election (appointment), but no earlier than the date of resignation from the previous place of work or suspension of their service, except for the case envisaged by Part 11, Article 6 of this Federal Law, and funds for the reimbursement of expenses associated with the exercising of their powers shall be paid from the date on which the decision on their election (appointment) enters into force. In the case envisaged by Part 11, Article 6 of this Federal Law, the monthly monetary compensation for members of the Federation Council shall be paid starting from the date on which the decision on their election (appointment) enters into force.

5. Monthly remuneration for members of the State Duma shall be paid starting from the day of election, but no earlier than the date of dismissal from the previous place of work or suspension of service, and the funds for the reimbursement of expenses related to the exercising of their powers shall be paid starting from the day of their election.

6. Members of the Federation Council, deputies of the State Duma, and members of their families shall be reimbursed for expenses associated with relocation to Moscow for the members of the Federation Council and deputies of the State Duma to exercise their powers as well as expenses associated with the relocation of members of the Federation Council and deputies of the State Duma and their family members to the permanent place of residence of the members of the Federation Council and deputies of the State Duma after the termination of their powers.

7. When relocating to Moscow, a member of the Federation Council and members of his/her family shall be paid a lump-sum monetary allowance: a member of the Federation Council shall receive an allowance in the amount of 0.5 and each family member shall receive an allowance in the amount of 0.25 of the monthly remuneration of a member of the Federation Council established on the day on which the decision on the election (appointment) of the member of the Federation Council enters into force.

8. When relocating to Moscow, a deputy of the State Duma and members of his/her family shall be paid a lump-sum monetary allowance: a deputy shall receive an allowance in the amount of 0.5 and each family member shall receive an allowance in the amount of 0.25 of the monthly remuneration of a deputy of the State Duma established on the day of elections to the State Duma.

9. A lump-sum monetary allowance shall be paid to a member of the Federation Council in the amount of his/her monthly remuneration no later than the day following the day of termination of his/her powers in connection with the entry into force of the decision to elect (appoint) a member of the Federation Council who is newly elected by the legislative (representative) body of the state authorities of a constituent entity of the Russian Federation or highest official of a constituent entity of the Russian Federation (senior official of the highest executive body of the state authorities of a constituent entity of the Russian Federation), respectively.

10. A deputy of the State Duma shall be paid a lump-sum monetary allowance in the amount of his/her monthly remuneration no later than the day following the expiration of his/her term of office in the event he/she is not elected to a new convocation of the State Duma.

 

Article 28. Annual paid leave of a member of the Federation Council and a deputy of the State Duma 

1. A member of the Federation Council and a deputy of the State Duma shall be granted annual paid leave of 42 calendar days.

2. In cases envisaged by the legislation of the Russian Federation, a member of the Federation Council and a deputy of the State Duma shall be granted leave exceeding the duration specified in Part 1 of this article.

Article 29. Medical, welfare, and pension benefits for a member of the Federation Council and a deputy of the State Duma 

1. A member of the Federation Council and a deputy of the State Duma shall be provided with medical, health resort, and welfare benefits under the conditions established for a federal minister. Medical, health resort, and welfare benefits for a member of the Federation Council and a deputy of the State Duma who suffered injury or other harm to their health when exercising their powers shall be retained by them after the termination of their powers according to the conditions established by this article.

2. A citizen of the Russian Federation who has exercised the powers of a member of the Federation Council or a deputy of the State Duma (except for a citizen whose powers as a member of the Federation Council and a deputy of the State Duma were terminated early in the case specified in clause e, Part 1, Article 4 of this Federal Law) for at least five years shall be entitled to a monthly supplemental payment for old-age (disability) insurance pension prescribed in accordance with Federal Law No. 400-FZ dated 28 December 2013 “On Insurance Pensions„ or to a pension prescribed ahead of schedule in accordance with the Law of the Russian Federation “On the Employment of the Population in the Russian Federation„ (hereinafter the monthly supplemental pension payment).

3. The monthly supplemental pension payment for a citizen specified in Part 2 of this article shall be established in such an amount that the sum of the monthly supplemental pension payment and old-age (disability) pension, taking into account the fixed payment to the insurance pension and the increases in the fixed payment to the insurance pension, amounts to: when a member of the Federation Council and/or a deputy of the State Duma exercises his/her power for five to ten years – 55 percent, or for ten years or more – 75 percent of the monthly remuneration of a member of the Federation Council and a deputy of the State Duma.

4. The amount of the monthly supplemental pension payment shall be recalculated in compliance with the rules envisaged by Part 3 of this article given an increase in the monthly remuneration of a member of the Federation Council and a deputy of the State Duma in a centralized manner.

5. A citizen of the Russian Federation who is a member of the Federation Council or a deputy of the State Duma and is simultaneously entitled to a monthly supplemental pension payment in accordance with this Federal Law, a length-of-service pension, monthly life-long support, monthly supplemental pension payment (monthly life-long support), or additional (life-long) monthly material support prescribed and funded by the federal budget in accordance with federal laws, acts of the President of the Russian Federation, and the Government of the Russian Federation as well as a length-of-service pension (monthly supplemental pension payment or other payments) established in accordance with the legislation of the constituent entities of the Russian Federation or acts of local government bodies in connection with the holding of state positions of the constituent entities of the Russian Federation or municipal posts or in connection with the fulfilment of the state civil service of the constituent entities of the Russian Federation or municipal service shall be granted a monthly supplemental pension payment in accordance with this Federal law or one of the other aforementioned payments of his/her choice.

6. A monthly supplemental pension payment shall be established based on an application from a citizen who is entitled to this payment by the decision of the head of the federal executive authority in charge of the social protection of the population.

7. The payment of a monthly supplemental pension payment to a citizen who was a member of the Federation Council or a deputy of the State Duma shall be suspended when he/she holds a public position of the Russian Federation, a public position of a constituent entity of the Russian Federation, or a municipal position on a permanent basis, a state service position of the Russian Federation, or a municipal service position. Upon being released from the corresponding position, the payment of a monthly supplemental pension payment shall resume or be reinstated.

9. The procedure for the establishment, payment, and resumption of the payment of the monthly supplemental pension payment envisaged by this Federal Law shall be determined by the Government of the Russian Federation.

Article 30. Provision of office premises to a member of the Federation Council and a deputy of the State Duma 

Separate office premises equipped with furniture, office equipment (including a personal computer connected to the general network, all available legal databases, and state information systems as well as a copying machinery and a fax machine), and communications facilities shall be provided to a member of the Federation Council and a deputy of the State Duma in the building of the corresponding chamber of the Federal Assembly of the Russian Federation so that they can exercise their powers.

 

Article 31. Use of communications facilities by a member of the Federation Council and a deputy of the State Duma
(as amended by Federal Law No. 42-FZ dated 9 May 2005) 

1. Bodies of the state authorities, local government bodies, and organizations on the territory of the Russian Federation must provide members of the Federation Council and deputies of the State Duma with all types of communication that these bodies and organizations have so that the latter may exercise their powers.

2. A member of the Federation Council and a deputy of the State Duma shall enjoy the right to use extraordinary communication services.

3. All types of postal and telegraph items of a member of the Federation Council and a deputy of the State Duma in connection with the exercising of their powers shall be sent (transmitted), processed, and delivered as government items.

4. Expenses of a member of the Federation Council and a deputy of the State Duma on the use of communications equipment shall be reimbursed to state bodies, local government bodies, and organizations using the funds earmarked by the federal law on the federal budget for the corresponding year for the operation of the Federation Council and the State Duma in the manner prescribed by Article 35 of this Federal Law.

5. The procedure for the use of communications facilities by members of the Federation Council and deputies of the State Duma to exercise their powers shall be established by the Federation Council and the State Duma, respectively.

 

Article 32. Right of a member of the Federation Council and a deputy of the State Duma to transport service 

1. A member of the Federation Council and a deputy of the State Duma shall be entitled to receive priority travel documents for air, railway, and water transport as well as long-distance buses on the territory of the Russian Federation with subsequent reimbursement to their respective organizations using the funds earmarked by the federal law on the federal budget for the corresponding year for the operation of the Federation Council and the State Duma in the manner prescribed by Article 35 of this Federal Law.

2. Upon presenting the credentials of a member of the Federation Council and a deputy of the State Duma, civil aviation agencies or airports, ticket offices (both daily and pre-sale) of railway terminals and stations, marine passenger terminals (ports), river stations, and waterway stations shall be required to give a member of the Federation Council or a deputy of the State Duma a free ticket for a single seat in an airplane or helicopter, sleeping or compartment car of a train, or a first- or second-class cabin in vessels of all categories.

3. A member of the Federation Council or a deputy of the State Duma shall travel in long-distance buses in the event tickets are sold with assigned seat numbers using a free ticket received on a priority basis at the ticket offices of bus terminals, bus stations, transport and forwarding agencies, or directly when boarding a bus.

5. A member of the Federation Council and a deputy of the State Duma shall be entitled to use VIP lounges for officials and delegations at airports and air terminals, railway terminals and stations, marine passenger terminals (ports), and river stations free of charge with subsequent reimbursement of the cost of such services to their respective organizations using the funds earmarked by the federal law on the federal budget for the corresponding year for the operation of the Federation Council and the State Duma in the manner prescribed by Article 35 of this Federal Law.

6. The rights of a member of the Federation Council and a deputy of the State Duma with a group I disability established by Parts 1–5 of this article shall also apply to an individual accompanying him/her.

7. A business vehicle shall be provided to a member of the Federation Council and a deputy of the State Duma as needed for travel in connection with the exercising of their powers on the territory of the Russian Federation by the state bodies of the constituent entities of the Russian Federation, and for travel around the city of Moscow and the Moscow Region by the relevant federal state bodies. A member of the Federation Council and a deputy of the State Duma may also use their own personal vehicles in connection with the exercising of their powers.

71. The expenses of the state authorities associated with the provision of motor transport to a member of the Federation Council or a deputy of the State Duma as well as expenses associated with the use of personal vehicles for the exercising of their powers shall be reimbursed to the state authorities, a member of the Federation Council, or a deputy of the State Duma, respectively, within the limits of the funds earmarked by the federal law on the federal budget for the corresponding year for the operation of the Federation Council and the State Duma in the manner and amount established by the corresponding chamber of the Federal Assembly of the Russian Federation.

Article 33. Right of a member of the Federation Council and a deputy of the State Duma to priority hotel accommodation 

The administrations of state and municipal hotels must provide a member of the Federation Council or a deputy of the State Duma with a separate room with a telephone within one hour. The right to priority hotel accommodation shall apply to an individual accompanying a member of the Federation Council or a deputy of the State Duma.

 

Article 34. Right of a member of the Federation Council and a deputy of the State Duma to housing accommodation in the city of Moscow
(as amended by Federal Law No. 42-FZ dated 9 May 2005) 

1. A member of the Federation Council or a deputy of the State Duma who does not have housing accommodations in the city of Moscow shall be provided with official fully-equipped housing accommodations for the period during which they exercise their powers within three months in the manner and according to the conditions envisaged by housing legislation. The list of items required for accommodation shall be established by the body formed (specified) in accordance with the regulation of the corresponding chamber of the Federal Assembly of the Russian Federation to consider matters related to the organization of the chamber’s activities in coordination with the federal executive body that provides social services for members of the Federation Council and deputies of the State Duma.

2. Prior to the provision of the official housing accommodation envisaged by Part 1 of this article, a member of the Federation Council or a deputy of the State Duma shall be granted a separate hotel room. A member of the Federation Council or a deputy of the State Duma shall be required to vacate the hotel room within seven days from the date on which they are provided with official housing accommodation.

3. Members of the Federation Council and deputies of the State Duma who have ceased exercising their powers shall be required to vacate their official housing accommodation provided in accordance with Part 1 of this article no later than one month from the date of the termination of their powers. The failure to vacate official housing accommodation shall result in eviction in the manner prescribed by housing legislation.

4. Payment for the housing specified in Part 1 of this Article shall be made using the funds earmarked by the federal law on the federal budget for the corresponding year for the operation of the Federation Council and the State Duma in the manner prescribed by Article 35 of this Federal Law. Payment for the utility services of a member of the Federation Council and a deputy of the State Duma shall be made at their own expense.

 

Article 35. Reimbursement of expenses associated with material support for the activities of a member of the Federation Council and a deputy of the State Duma 

(as amended by Federal Law No. 42-FZ dated 9 May 2005) 

1. Expenses associated with the material support of the activities of a member of the Federation Council and a deputy of the State Duma shall be made using the funds earmarked by the federal law on the federal budget for the corresponding year for the operation of the Federation Council and the State Duma in accordance with the legislation of the Russian Federation.

2. Expenses associated with the material support of the activities of a member of the Federation Council and a deputy of the State Duma, except for expenses established in accordance with Part 3, Article 27 of this Federal Law, shall be made using the funds transferred by the Federation Council and the State Duma, respectively, to the accounts of the relevant state bodies, local government bodies, and organizations. At the same time, expenses associated with the material support of a member of the Federation Council in a constituent entity of the Russian Federation as well as expenses associated with the material support of a deputy of the State Duma in the territory determined in accordance with Part 1, Article 8 of this Federal Law shall be made by the legislative (representative ) or executive body of the state authorities of a constituent entity of the Russian Federation using the funds transferred by the Federation Council and the State Duma, respectively, to the account of the legislative (representative) or executive body of the state authorities of the constituent entity of the Russian Federation.

3. Expenses associated with material support for the activities of a member of the Federation Council and a deputy of the State Duma established in accordance with Part 3, Article 27 of this Federal Law shall be made by the member of the Federation Council and deputy of the State Duma, respectively.

 

Article 36. Diplomatic passport of a member of the Federation Council and a deputy of the State Duma 

A member of the Federation Council and a deputy of the State Duma shall be issued a diplomatic passport for their entire term of office.

 

Article 37. Aides of a member of the Federation Council and a deputy of the State Duma 

(as amended by Federal Law No. 42-FZ dated 9 May 2005) 

1. A member of the Federation Council may have aides for work in the Federation Council and for work in a constituent entity of the Russian Federation. A deputy of the State Duma may have aides for work in the State Duma and for work in the territory assigned to deputy of the State Duma in accordance with Part 1, Article 8 of this Federal Law (hereinafter referred to as an aide to a deputy of the State Duma for work in the corresponding territory). A member of the Federation Council and a deputy of the State Duma may have up to seven aides working on a fixed-term service contract or a fixed-term employment contract. The number of aides of a member of the Federation Council and a deputy of the State Duma working on a fixed-term service contract or a fixed-term employment contract for work in the Federation Council and the State Duma, respectively, may not exceed two.

2. An aide to a member of the Federation Council and a deputy of the State Duma working on a fixed-term service contract in the Federation Council and State Duma, respectively, shall be a federal civil servant of the “aides (advisers)„ category who holds an advanced position in the federal state civil service. Legislation on the state civil service of the Russian Federation shall extend to such aides in full.

3. Aides of a member of the Federation Council and a deputy of the State Duma working on a fixed-term employment contract may work both on a permanent basis and part-time.

4. A member of the Federation Council and a deputy of the State Duma may have up to forty assistants working on a voluntary basis for work in the Federation Council and State Duma, respectively, and also for work in a constituent entity of the Russian Federation (for members of the Federation Council) and in the territory determined in accordance with Part 1, Article 8 of this Federal Law (for deputies of the State Duma).

5. An aide of a member of the Federation Council and a deputy of the State Duma may only be a citizen of the Russian Federation.

6. A certificate shall be issued to an aide of a member of the Federation Council and a deputy of the State Duma. The certificate issued to an aide of a member of the Federation Council shall state that he/she is an aide of the member of the Federation Council for work in the Federation Council or for work in a constituent entity of the Russian Federation (indicating the name of the constituent entity of the Russian Federation). The certificate issued to an aide of a deputy of the State Duma shall state that he/she is an aide of a deputy of the State Duma for work in the State Duma or for work in the corresponding territory (indicating the name(s) of the constituent entity (entities) of the Russian Federation). The certificate of an aide of a member of the Federation Council or a deputy of the State Duma working on a voluntary basis shall contain an entry indicating that he/she is working on a voluntary basis.

7. Aides of members of the Federation Council for work in the Federation Council and aides of deputies of the State Duma for work in the State Duma shall be provided with a single equipped workplace in the office space provided to the member of the Federation Council or deputy of the State Duma in the building of the Federation Council or in the building of the State Duma, respectively, in accordance with Article 30 of this Federal Law.

8. A permanent workplace for aides of a member of the Federation Council for work in a constituent entity of the Russian Federation and aides of deputies of the State Duma for work in the relevant territory shall be a properly equipped space provided by the relevant legislative (representative) or executive government body of the constituent entity of the Russian Federation in the building of the legislative (representative) or executive body of the state authorities of the constituent entity of the Russian Federation or a local government body in the building of a local government with the consent of a member of the Federation Council or a deputy of the State Duma.

9. In the event of the detention, arrest, or criminal or administrative prosecution imposed in court of an aide of a member of the Federation Council or a deputy of the State Duma, the relevant authorities must immediately report this to the member of the Federation Council or deputy of the State Duma.

 

Article 38. Hiring and dismissal of an aide of a member of the Federation Council and a deputy of the State Duma 

1. The aides of a member of the Federation Council and a deputy of the State Duma specified in Part 2, Article 37 of this Federal Law shall be hired in accordance with the legislation on the state civil service of the Russian Federation. Fixed-term service contracts with the aforementioned aides shall be concluded based on an order of the senior official of the office of the corresponding chamber of the Federal Assembly of the Russian Federation or an order of the deputy senior official of the office of the corresponding chamber of the Federal Assembly of the Russian Federation authorized by the senior official. Other aides shall be hired based on a fixed-term employment contract in accordance with labour legislation.

2. A fixed-term service contract or a fixed-term employment contract shall be concluded based on an application from an aide of a member of the Federation Council and a deputy of the State Duma and the proposal of a member of the Federation Council and a deputy of the State Duma for the period specified in the proposal but shall not exceed the term of office of a member of the Federation Council or deputy of the State Duma.

3. The hiring of an aide of a member of the Federation Council and a deputy of the State Duma for work in the corresponding chamber of the Federal Assembly of the Russian Federation based on a fixed-term employment contract shall be documented by an order of the senior official of the office of the corresponding chamber of the Federal Assembly of the Russian Federation or an order of the deputy senior official of the office of the corresponding chamber of the Federal Assembly of the Russian Federation authorized by the senior official.

4. The hiring of an aide of a member of the Federation Council for work in a constituent entity of the Russian Federation shall take place based on a fixed-term employment contract and be documented by an order of the senior official of the relevant legislative (representative) or executive body of the state authorities of the constituent entity of the Russian Federation or a local government body.

5. The hiring of an aide of a deputy of the State Duma for work in the relevant territory shall take place based on a fixed-term employment contract and be documented by an order of the senior official of the relevant executive body of the state authorities of a constituent entity of the Russian Federation.

6. The hiring of an aide of a member of the Federation Council and a deputy of the State Duma may take place starting from the day on which the aide actually begins performing his/her duties if this is specified in the proposal of the member of the Federation Council or deputy of the State Duma, but no earlier than the day on which the member of the Federation Council or deputy of the State Duma begins exercising his/her powers.

7. The administration of an organization shall be required to dismiss an employee who expresses a desire to transfer to work as an aide of a member of the Federation Council or a deputy of the State Duma in a lateral hire within the period specified in the application and the proposal of the member of the Federation Council or deputy of the State Duma.

8. Rank and file or commanding officers of the internal affairs bodies or the State Fire Service and employees of prosecutorial authorities, the Investigative Committee of the Russian Federation, customs authorities, narcotics and psychotropic control authorities, or institutions and bodies of the penal system shall be seconded to work as an aide under an employment agreement (contract) based on a proposal of a member of the Federation Council or a deputy of the State Duma to the relevant executive body of the state authorities. At the same time, service in the internal affairs bodies, the State Fire Service, prosecutorial authorities, the Investigative Committee of the Russian Federation, customs authorities, or institutions and bodies of the penal system shall be suspended for these individuals.

9. Repealed – Federal Law No. 42-FZ dated 9 May 2005.

10. The dismissal of an aide of a member of the Federation Council or a deputy of the State Duma prior to the expiration of a fixed-term service contract or fixed-term employment contract shall take place:

 (as amended by Federal Law No. 42-FZ dated 9 May 2005)

a) based on the proposal of a member of the Federation Council or a deputy of the State Duma;

b) in the event of early termination of the powers of a member of the Federation Council or a deputy of the State Duma regardless of the duration of the fixed-term service contract or fixed-term employment contract;

c) at the request of an aide of a member of the Federation Council or a deputy of the State Duma;

d) on other grounds established by labour legislation or legislation on the state civil service of the Russian Federation (for aides of a member of the Federation Council or a deputy of the State Duma who holds positions of the federal state civil service in accordance with Part 2, Article 37 of this Federal Law).

11. In the event of the dismissal of an aide of a member of the Federation Council or deputy of the State Duma on the grounds envisaged by clause b, Part 10 of this Article, a lump-sum allowance shall be paid to the aide in the amount of three months of the aide’s remuneration.

12. An aide of a member of the Federation Council or deputy of the State Duma who is dismissed in connection with the expiry of the term of office of the member of the Federation Council or deputy of the State Duma shall be given his/her previous job (position) if he/she worked as an assistant in state bodies or in local government bodies prior to hiring.

13. Aides of a member of the Federation Council or deputy of the State Duma, in the event of the early termination of their powers, must return their credentials to the member of the Federation Council or deputy of the State Duma for whom they served as an aide so that the credentials can be transmitted to the state body that issued them.

 

Article 39. Rights and obligations of an aide of a member of the Federation Council and a deputy of the State Duma 

1. An aide of a member of the Federation Council and a deputy of the State Duma shall:

a) maintain a record of people received by a member of the Federation Council or a deputy of the State Duma and handle the preliminary reception;

b) prepare analytical, informational, reference, and other materials necessary for a member of the Federation Council or a deputy of the State Duma to exercise his/her powers;

c) receive documents on behalf of a member of the Federation Council and deputy of the State Duma, including travel documents on a priority basis, as well as information and reference materials that the member of the Federation Council or deputy of the State Duma needs to exercise his/her powers from the state authorities, election commissions, referendum commissions, local authorities, organizations, and public associations;

d) organize the sittings of a member of the Federation Council or deputy of the State Duma with voters;

e) handles records management;

f) execute other orders of a member of the Federation Council or deputy of the State Duma envisaged by a fixed-term service contract or fixed-term employment contract.

2. An aide of a member of the Federation Council and a deputy of the State Duma shall be entitled to:

a) use copy, duplicating, and computing equipment available to the state authorities, local government bodies, and organizations located on the territory of the corresponding constituent entity of the Russian Federation or in a territory determined in accordance with Part 1, Article 8 of this Federal Law;

b) receive postal and telegraph items addressed to a member of the Federation Council or a deputy of the State Duma;

c) free travel on long-distance trains and buses: for an aide to a member of the Federation Council – within the corresponding constituent entity of the Russian Federation, for an aide of a deputy of the State Duma – within the territory assigned to the deputy of the State Duma in accordance with Part 1, Article 8 of this Federal Law. Travel in long-distance trains and buses in the event tickets are sold with assigned seat numbers shall take place using a free ticket received on a priority basis at the ticket offices of bus terminals, bus stations, transport and forwarding agencies, or directly when boarding a train or bus;

d) use VIP lounges for officials and delegations of airport terminals and airports, railway terminals and stations, marine passenger terminals (ports), and river stations if they are travelling on official business together with a member of the Federation Council or a deputy of the State Duma (except for aides working on a voluntary basis);

e) freely enter the buildings of the state authorities, local government bodies, and organizations on behalf of a member of the Federation Council or a deputy of the State Duma.

 

Article 40. Conditions and procedure for the remuneration of an aide of a member of the Federation Council or a deputy of the State Duma working under an employment agreement (contract) 

1. A member of the Federation Council and a deputy of the State Duma shall have a general monthly payroll for their aides in the amount of RUB 231,084. Remuneration for aides who hold positions in the federal state civil service in accordance with Part 2, Article 37 of this Federal Law shall be paid in accordance with Article 50 of Federal Law No. 79-FZ dated 27 July 2004 “On the Civil Service of the Russian Federation„. A member of the Federation Council and deputy of the State Duma shall independently establish the amount of remuneration for their aides working on a fixed-term employment contract.

11. The amount of the payroll specified in Part 1 of this article shall be increased (indexed) in accordance with the federal law on the federal budget for the corresponding year taking into account the level of inflation (consumer prices). If the payroll is increased (indexed), its amount shall be rounded up to the nearest whole rouble.

12. A member of the Federation Council or a deputy of the State Duma may spend funds constituting the difference between the amount of the payroll established in Part 1 of this article and the amount paid per month under a fixed-term service contract or fixed-term employment contract to aides of a member of the Federation Council or a deputy of the State Duma in order to provide material incentives to aides of a member of the Federation Council or a deputy of the State Duma.

2. All payments to aides of a member of the Federation Council or a deputy of the State Duma established in Part 1 of this Article shall be made within the limits of the established payroll for aides of a member of the Federation Council or a deputy of the State Duma.

3. For aides of a member of the Federation Council or a deputy of the State Duma working in localities in which employees of budget-funded organizations are paid additional payments in the form of locality pay factors and percentage increments, the same procedure for granting supplemental payments to the established salary of an aide of a member of the Federation Council or a deputy of the State Duma shall be established. In this case, the total monthly payroll for aides of a member of the Federation Council and a deputy of the State Duma shall be increased by the amount of these supplemental payments.

4. A business trip by an aide of a member of the Federation Council or a deputy of the State Duma shall be documented upon submission by a member of the Federation Council or a deputy of the State Duma of an order of the senior official of the office of the corresponding chamber of the Federal Assembly of the Russian Federation or by an order of the deputy senior official of the corresponding chamber of the Federal Assembly of the Russian Federation (for aides working in the Federation Council and the State Duma), the senior official of the legislative (representative) or executive body of the state authorities of a constituent entity of the Russian Federation, or the senior official of a local government body (for other aides).

5. During a business trip, the aide of a member of the Federation Council or a deputy of the State Duma shall be paid a per diem as well as reimbursement of expenses for living accommodations and transportation expenses in the manner and in the amounts stipulated by the legislation of the Russian Federation.

6. Expenses on the remuneration of aides of a member of the Federation Council or a deputy of the State Duma and their salaries shall be reimbursed using the resources of the federal budget in the manner prescribed by Article 35 of this Federal Law.

7. An aide of a member of the Federation Council or a deputy of the State Duma working on a fixed-term service contract or a fixed-term employment contract shall be provided with annual paid leave based on a written application and the proposal of a member of the Federation Council or a deputy of the State Duma. An aide of a member of the Federation Council or a deputy of the State Duma working in the Federation Council or the State Duma on a fixed-term service contract shall be granted annual paid leave in accordance with the legislation on the state civil service of the Russian Federation. An aide of a member of the Federation Council or a deputy of the State Duma working on a fixed-term employment contract shall be granted annual paid leave in accordance with labour legislation.

Chapter III. LIABILITY FOR THE FAILURE TO FULFIL THE PROVISIONS OF THIS FEDERAL LAW 

Article 41. Liability for creating obstacles in the implementation of the activities of a member of the Federation Council or a deputy of the State Duma 

The failure by officials and other employees of the state authorities, election commissions, referendum commissions, local government bodies, organizations, and public associations to fulfil the provisions of this Federal Law, including the provision of deliberately false information or the failure to comply with the terms and procedure for providing information established by this Federal Law, the violation of the provisions of this Federal Law governing matters concerning the immunity of a member of the Federation Council and a deputy of the State Duma shall entail the liability envisaged by administrative and criminal law.

 

Article 42. Liability for unlawfully influencing a member of the Federation Council and a deputy of the State Duma, members of their families, and other relatives 

Unlawfully influencing a member of the Federation Council or a deputy of the State Duma as well as members of their families and other relatives in the form of violence or the threat of violence in order to terminate their activities as a member of the Federation Council or a deputy of the State Duma or in order to alter the nature of such activities shall entail liability under criminal legislation.

 

Article 43. Demonstrating disrespect towards a member of the Federation Council or a deputy of the State Duma 

Disrespect for a member of the Federation Council or a deputy of the State Duma expressed in the form of any action that demonstrates a clear disregard for the Federal Assembly of the Russian Federation or the rules established by this Federal Law shall entail the liability envisaged by administrative legislation.

 

Chapter IV. FINAL PROVISIONS 

Article 44. Entry into force of this Federal Law 

1. This Federal Law shall enter into force on the day of its official publication, except for Part 5 of Article 37 concerning the registration of the credentials of the aides of deputies of the State Duma, which shall enter into force on the day the third convocation of the State Duma commences its work.

2. The provisions of this Federal Law establishing the social protection guarantees of a member of the Federation Council and a deputy of the State Duma shall also apply to deputies of the first convocation of the Federation Council who are exempted from performing job or official duties over the course of their exercising their deputy powers, to members of the Federation Council who have exercised or have continued to exercise their powers since January 1996 as well as deputies of the first and second convocations of the State Duma, except for deputies of the first convocation of the State Duma who were simultaneously members of the Government of the Russian Federation.

3. The provisions of Parts 2, 3, 4, 5, 6, and 7, Article 29 of this Federal Law establishing the pension benefits of a deputy of the State Duma shall also apply to People’s Deputies of the 1990–1995 convocation of the RSFSR who were members of the Supreme Soviet of the Russian Federation or performed their deputy activities on the Supreme Soviet of the Russian Federation or its bodies on a permanent basis.

Article 45. Harmonization of regulatory legal acts with this Federal Law 

Regulatory legal acts of the President of the Russian Federation, the Government of the Russian Federation, departmental regulatory legal acts, regulatory legal acts of bodies of the state authorities of the constituent entities of the Russian Federation and local government bodies shall be brought into compliance with this Federal Law within two months from the date of its entry into force.
